sent the wrong 1st Amendment to the States for ratification.
On this, the 225-year
anniversary of framing, approving, and transmitting the Bill of Rights, author
and independent scholar Stanley Yavneh Klos has notified the Attorneys General
of 11 States that their legislatures may have ratified the wrong first amendment
to the United States Constitution.
the First, the first of 12 amendments approved by
the 1789 Congress on September 25th, 1789, remains the only article not
ratified by the States. Articles 3-12
were ratified as the Bill of Rights and Article
the Second was ratified in 1992 as the 27th Amendment.
According to Klos, “President George Washington transmitted
the wrong first amendment to the States in a 12 Amendment Congressional
resolution commonly known as the Bill of Rights – a document currently on display
at the National Archives. The September 25th, 1789, constitutional
amendment resolution passed by Congress, however, actually proposed the U.S.
Senate’s and not the House’s version of Article the First as the first
amendment to the US Constitution. George Washington was the Commander-in-Chief
and not President of the Republic under the Articles of Confederation, Pluto is
not a planet, and 11 States ratified the wrong first amendment to the United
September 22nd, 2014, Klos sent his research along with a letter to
each of the Attorneys General of the ratifying 11 States advising “… that their respective
State might have ratified the incorrect Article the First amendment to the U.S.
Constitution.” Klos asks each of the
Attorneys General that “if they agree
with the attached findings, to transmit the correct Article the First Amendment
(with their legal opinion) to their respective State legislatures for

The 11 States that ratified
Article the First are Virginia on
November 3, 1789; New Jersey on November 20, 1789; Maryland on December 19,
1789; North Carolina on December 22, 1789; South Carolina on January 19, 1790;
New Hampshire on January 25, 1790; New York on March 27, 1790; Rhode Island on
June 15, 1790; Pennsylvania on September 21, 1791; Vermont on November 3, 1791
and Kentucky on June 24, 1792.
